Welcome to MyComplianceLink (the "Service"). These Terms of Use ("Terms") govern your access to and use of our digital compliance portal. By purchasing a subscription or accessing our services, you (the "User" or "Employer") agree to be bound by these Terms.
1. NO LEGAL ADVICE
MyComplianceLink is a software-as-a-service (SaaS) provider, not a law firm. The Service provides a platform for hosting and accessing labor law notices.
- We do not provide legal advice, legal opinions, or recommendations regarding your specific business's compliance requirements.
- Use of the Service does not create an attorney-client relationship.
- You are strongly encouraged to consult with legal counsel to ensure your business meets all requirements of New York Labor Law § 201.
2. LIMITATION OF LIABILITY (THE "LIABILITY CAP")
To the maximum extent permitted by New York law, MyComplianceLink, its owners, and employees shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to:
- Fines or penalties issued by the New York Department of Labor or any other government agency.
- Legal fees or costs resulting from employee lawsuits or audits.
- Lost profits or business interruption.
TOTAL LIABILITY CAP: In no event shall our total liability for any claim arising out of the Service exceed the total amount paid by you to MyComplianceLink during the twelve (12) months immediately preceding the event giving rise to the claim.
3. USER RESPONSIBILITIES (NOTIFICATION REQUIREMENT)
New York Labor Law § 201 requires employers to actively notify employees of where they can find digital notices.
- Your Duty: You are solely responsible for distributing your unique compliance link or QR code to your employees (e.g., via email, employee handbook, or physical posting).
- Our Protection: MyComplianceLink is not liable if a user fails to properly notify employees or if employees lack the technical means provided by the employer to access the link.
4. ACCURACY OF THIRD-PARTY CONTENT
Our Service displays posters and notices sourced directly from the New York Department of Labor (DOL) and federal agencies.
- While we strive to update links within 24–72 hours of a legal change, we do not warrant that all documents are the most current at every second.
- We are not responsible for errors or omissions contained within the government-issued PDFs themselves.
5. SERVICE UPTIME & "AS-IS" PROVISION
- The Service is provided on an "AS-IS" and "AS-AVAILABLE" basis.
- We do not guarantee 100% uptime. You acknowledge that temporary service interruptions may occur and that MyComplianceLink is not liable for non-compliance during such downtime.
6. SUBSCRIPTION AND CANCELLATION
- Billing: Subscriptions are billed annually.
- Automatic Renewal: Your subscription will automatically renew unless cancelled at least 30 days prior to the renewal date.
- No Refunds: Due to the immediate delivery of digital compliance assets, all sales are final.
7. GOVERNING LAW & VENUE
These Terms shall be governed by the laws of the State of New York. Any legal action or proceeding related to the Service shall be brought exclusively in the courts of New York County, New York.
8. INDEMNIFICATION
You agree to indemnify and hold harmless MyComplianceLink from any claims, damages, or expenses (including attorney fees) arising from your use of the Service or your violation of these Terms.
